OMNIAVET – COMPLETE END USER LICENSE AGREEMENT (EULA) & TERMS OF SERVICE

This End User License Agreement (« Agreement » or « EULA ») is a binding, enforceable legal contract between you (an individual user, hereinafter « User », « You », or « Your ») and Serrapps (hereinafter « Licensor », « We », « Us », or « Our »), the sole author, developer, and owner of the mobile application OmniaVet (including its versions, subsystems, and iterations for iPhone, iPad, Apple Watch, and Mac, hereinafter collectively referred to as the « Application »).

By downloading, installing, purchasing a subscription, activating, accessing, or using the Application, You explicitly and unreservedly agree to be bound by the entire terms and conditions of this Agreement. If You do not agree to every single term of this Agreement, do not download, install, buy subscriptions, or use the Application in any manner.

1. ABSOLUTE MEDICAL & VETERINARY DISCLAIMER: NOT A SUBSTITUTE FOR PROFESSIONAL DIAGNOSIS OR CARE

CRITICAL LEGAL WARNING — PLEASE READ CAREFULLY

THE APPLICATION IS PROVIDED SOLELY AND EXCLUSIVELY AS A LOGISTICAL, ORGANIZATIONAL, AND PERSONAL MANAGEMENT TOOL. OMNIAVET, ITS CODEBASE, AND ITS LICENSOR DO NOT PROVIDE MEDICAL, VETERINARY, DIAGNOSTIC, PHARMACEUTICAL, OR CLINICAL TREATMENT ADVICE.

All computational outputs, dynamic graphs, metrics, automated alerts, and recommendations generated by the Application—including but not limited to food rationing guidelines (for Dry, Wet, Home-Cooked, or BARF diets), automatic growth curves, BMI indicators, veterinary vaccine schedules, medication tracking loops, geofencing safe zones, and environmental/weather thermal paw warnings (Bitume brûlant)—are exclusively processed via automated software algorithms, local data indexing, and generic statistical baselines. They do not, under any circumstances, take into account the unique physiological state, latent pathologies, specific allergies, or complete clinical history of Your animal.

THE APPLICATION MUST NEVER BE USED TO REPLACE, OVERRIDE, COUNTERMAND, OR DELAY COMPREHENSIVE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT FROM A LICENSED, CERTIFIED, AND PRACTICING VETERINARY PROFESSIONAL.

In the event of an emergency, acute or chronic illness, physical trauma, behavioral anomalies, or any suspected health deterioration of Your animal, You must immediately consult a qualified veterinarian or contact a local 24/7 emergency veterinary hospital.

The Licensor explicitly disclaims any and all liability for injury, disease, illness, diagnostic failure, treatment errors, or the death of any animal resulting directly or indirectly from reliance upon, usage of, or misinterpretation of the metrics and alerts compiled by the Application. YOU ASSUME 100% SOLE OPERATIONAL RESPONSIBILITY AND ALL ASSOCIATED RISKS FOR THE GENERAL HEALTH, MEDICAL MONITORING, SURVEILLANCE, AND NUTRITION OF YOUR ANIMALS.

2. SCOPE OF LICENSE & USER RESTRICTIONS

Subject to Your absolute compliance with this Agreement and the payment of any applicable fees, Licensor grants You a limited, non-exclusive, non-transferable, non-sublicensable, non-assignable, and revocable license to install and use the Application on Apple-branded devices running iOS, iPadOS, watchOS, or macOS that You own or control, strictly as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

2.1 Explicit Restrictions

You shall not, and You shall not permit any third party to:

  • Decompile, reverse engineer, disassemble, decrypt, attempt to derive the source code of, or modify the Application or any of its updates.

  • Sublicense, rent, lease, sell, distribute, redistribute, or publicly display the Application, its skeuomorphic assets, graphic donut charts, or its proprietary local database schemas.

  • Exploit the Application’s App Intents, local network requests, or communication interfaces to build a competing software platform.

3. COMPREHENSIVE SPECIFICATION OF SERVICES & LOGISTICAL TOOLS

The Application operates as a sandboxed local ecosystem incorporating the following modular frameworks governed by this EULA:

  • Pet Identity Management: Registry of baseline animal identity attributes, multi-species classification, breed catalog sheets (including specialized parameters for giant canine profiles), microchip tracking, and the compassionate memorial framework (« Rainbow Bridge »).

  • Digital Health Log & Local OCR: Medical archiving ledger, document ingestion pipelines, and Apple Vision-framework-based Optical Character Recognition (OCR) text indexing for prescriptions. Includes the « Chrono Tartre » interactive haptic brushing timer and weight/size trajectory graphs.

  • Nutrition Pantry & Telemetry (« Garde-manger »): Automated configuration models for Industrial, Home-Cooked (Ration Ménagère), and BARF diets with real-time stock depletion indicators, batch preparation slider tools (« Préparations »), and automated push notifications for thawing cycles.

  • Activity Tracking & Safety Geofencing: Record loops for physical activity, grooming, and resting periods. CoreLocation GPS track mapping, safety geofencing grids, and localized thermal weather alerts.

  • Accounting & Receipt Processing: Expense ledger tracking, localized budgeting limits, and OCR invoice scanning.

  • Insurance Optimization (« Prévoyance »): Itemized insurance coverage input matrices (eleven distinct tiers), automated claim calculation tools, recurring premium calendar tracking, local OCR indexing of policy rules, and Apple Wallet pass (.pkpass) generation.

  • Sitter Ecosystem Sharing: Encrypted offline QR code generation (Pass Sitter QR) allowing temporary, sandboxed read/write guest profiles for third-party pet caretakers without data harvesting.

  • Connected Integrations: Automatic Apple Watch connectivity, Siri App Intents voice commands, and private device synchronization.

4. SUBSCRIPTIONS AND IN-APP PURCHASES

4.1 Monetization Framework & Paywall Boundaries

The Application is distributed under a freemium model. The Free Tier version implements structural limitations, restricting the maximum number of active pet profiles, throttling multi-page OCR document parsing depth, and disabling background continuous GPS telemetry and advanced watchOS complications. Full unrestricted utility requires a premium auto-renewable monthly or annual subscription.

4.2 Apple In-App Purchase Processing (StoreKit 2)

All monetary transactions, plan selections, recurring billing management, and subscription state evaluations are processed natively by Apple Inc. through its secure StoreKit 2 framework. You acknowledge that the Licensor has zero direct access to, or control over, Your banking tokens, credit card data, or Apple ID payment history.

4.3 Cancellation and Refund Sovereign Authority

  • Cancellations: You may cancel Your premium subscription at any time via Your Apple ID Account Settings on iOS/macOS.

  • Refunds: To the maximum extent permitted by applicable law, all purchases are final. Any and all requests for monetary refunds must be submitted directly to Apple via their official channels (reportaproblem.apple.com). The Licensor does not possess the technical or legal authority to issue financial refunds.

5. ABSOLUTE PRIVACY, SANDBOXING & LOCAL PROCESSING COMPLIANCE

5.1 Localized Edge Processing

The Application is architected with a strict privacy-first model. Core computations, Vision OCR character parsing, budget evaluations, and biometric processing execute exclusively on Your physical device’s local sandbox.

5.2 Apple iCloud CloudKit Containment

Synchronization of your personal pet data, document assets, and history records across Your Apple devices is performed transparently via Apple’s private iCloud (CloudKit) storage containers. The Licensor does not host, manage, own, sell, intercept, or possess any access rights to Your private files, database schemas, uploaded insurance documents, or location tracks. ### 5.3 External Anonymous API Boundaries The Garde-manger scanner module issues anonymous network GET queries to the public, open-source Open Pet Food Facts API endpoint to fetch product details. No personal profile data, pet metadata, or unique device identifiers are appended to these network packets.

6. GEOGRAPHIC RUNTIME VALIDATION & LOCAL LAWS

The Application is published on App Store storefronts globally. You bear sole and exclusive legal responsibility for ensuring that Your use of the Application (specifically background location tracking, data scanning, and digital insurance logging) complies fully with all local, provincial, state, national, or international animal registry regulations, civil liabilities, and privacy frameworks in force within Your jurisdiction.

7. EXCLUSION OF WARRANTIES & LIMITATION OF LIABILITY

7.1 « As-Is » and « As-Available » Warranties

THE APPLICATION IS DISTRIBUTED TO YOU « AS IS » AND « AS AVAILABLE » WITH ALL FAULTS, GLITCHES, AND DEFECTS, WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

7.2 Telemetry Disclaimer

The Licensor does not warrant that the Application’s automated background alert loops (e.g., expiration dates, defrost buffers, thermal conditions, geofencing triggers, or premium insurance calendars) will fire with absolute accuracy or without interruption. Software performance may be degraded by device sleep states, camera glare obscuring OCR accuracy, hardware constraints, or operating system battery-saving throttling.

7.3 Cap on Liability & Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF PRIVATE DATA, PHYSICAL PROPERTY DAMAGE, EXTRAORDINARY VETERINARY FEES, CLINICAL COSTS, INJURY OR DEATH OF AN ANIMAL, OR BUSINESS INTERRUPTION) ARISING OUT of OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE APPLICATION, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. INTEGRAL SECURITY & BIOMETRIC ENFORCEMENT

The Application provides local access protection via Apple’s native LocalAuthentication biometric framework (Face ID / Touch ID). You acknowledge that this protection layer is entirely dependent on the security configuration of Your physical hardware. The Licensor is not liable for unauthorized access to Your local application vault if Your physical device passcode is compromised or shared with third parties.

9. GOVERNING LAW & SEVERABILITY

9.1 Governing Jurisdiction

This Agreement, and any legal dispute, claim, or litigation arising out of or in connection with it, shall be governed by, interpreted, and construed exclusively in accordance with the laws of France, without regard to its conflict of law principles. Any legal action or judicial proceeding related to this Application shall be brought exclusively before a court of competent jurisdiction located in France.

9.2 Severability Clause

If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable under applicable local laws, such provision shall be modified to achieve the original intent of the clause to the maximum extent possible, and the remaining blocks of this EULA shall continue in absolute full force and effect.
